UK - A judge in Britain's Court of Protection, has ruled that a 29 year old woman should be banned from having sex. The terms of the order makes it an offence for any male to attempt to have sex with her could be charged with sexual assault or rape.

If a man was convicted of attempting to have sex with the woman, they would have to sign the sex offenders register.

Mr Justice Hedley said that the autistic woman had an IQ of 64 should be banned from having sexual intercourse on the grounds she does not fully understand she could say no to such actions.

The judge claimed that the woman lacks the mental capacity to consent to having sex, and made the order to protect her best interests.

He went on she had to be protected from 'potentially exploitative and damaging' relations in the future, as she had already been involved in risky behaviour with people.

It is to be thanked that the Judge has not ordered the woman to be sterilised. He was asked to do this in another case some time ago.

But the case bears disturbingly similar story to another brought before Mr Justice Mostyn of a man knows as Alan where the Judge agreed that the man did not have the mental capacity to understand the health risks and should not have sex with anyone. The judge's order put Alan under the local authority that provides his housing.

We do have to say that the state should never have the right to prevent anyone from having sex unless they are convicted Rapists!

Surely the most basic human right is to be able to have sex as long as children and animals are not involved. The fact that someone, usually a social worker finds the subject unpleasant or distasteful, is not justifiable in any way to legally prevent people from having sex.

This also has parallels with social workers trying to prevent old people, from having sexual liaisons at nursing Holmes. Just who the hell are we, or society in the form of some jumped up ass of a Judge, to say that they should not.

The court of protection was set up in 2007  under the Mental Capacity Act 2005
